Will you really be able to Ware and Play the 3DS?

Eagle-eyed games site Siliconera have managed to uncover a Nintendo trademark patent for the new 3DS and there are no prizes for guessing what it is.

The article features a screen grab of a proposed '3DSWare' and '3DSPlay' which does appear to imply what the new handheld will have the same downloadable functionality as the DSi whilst also featuring a WiiPlay equivalent. What do you think?
